Summary

The Act has broad application to arrangements that may be in place between employers and employees, particularly bearing in mind that it will pertain to salary sacrifice arrangements that may be in place between the parties. The Act will also apply to issues such as overpayments to employees.

A 6-month transitional period pertaining to existing deduction arrangements has effectively been provided for by the legislation commencing on 1 December 2008. In the meantime, employers and employees in Victoria will need to ensure that their arrangements are compliant with the Act.
