Victorian Workers’ Wages Protection Act 2007 Continued - Page 2

The Act provides that an employer is to pay all of an employee’s wages in money and provides the means by which that payment may take place. Further, it states that no deductions may be made from wages unless the employer:

  1. Has received a valid written authority from the employee in accordance with the Act; and
  2. The deduction is made strictly in compliance with instructions contained in that authority; or
  3. The employer is otherwise required or authorised to make the deduction by law.

In addition, in the event that a deduction is proposed for the benefit of that employer or a related party (as defined) the employer must inform the employee, in writing:

  • of the reason for the proposed deduction;
  • the identity of whom the deduction is to be in favour;
  • its amount;
  • whether it is a single or multiple deduction;

and

  • the date(s) or period over which the deduction is proposed to be made.
