c. State or Territory OH&S issues

A permit holder may enter premises or access records relating to state-based OH&S legislation provided that the legislation provides for obligations or otherwise directly affects the employer.

d. General

In each of the cases entry must be strictly in accordance with the requirements of the legislation and certain requirements exist in relation to those who seek to exercise such rights.

Fair Work Australia

A new institution is being formed to replace the Australian Industrial Relations Commission, the Australian Industrial Registry, the Australian Fair Pay Commission, the Workplace Authority, the Workplace Ombudsman and the Australian Building and Construction Commission. That institution will be known as Fair Work Australia (‘FWA’).

Effectively, FWA is intended as the one-stop shop for industrial issues. It is stated that it will be easy to access, informal, less adversarial than current approaches and less legalistic.
