The assessment will be passed in the event that an employee or employees do not, on balance, receive an overall reduction in terms and conditions of employment when compared with the reference instrument.

Agreement making – Fair Work Bill

Under the Fair Work Bill, individual agreements are not available. A new form of collective agreement will be in place which is stated to provide for less regulation in agreement making. Essentially there will be a single stream of agreement-making rather than the multiple streams available under current legislation.

The agreements are to be made between employers and employees and contents of the proposed agreement may involve:

  1. Matters pertaining to the relationship between the employer and employees;
  2. Matters pertaining to the to the relationship between the employer and employee organisations covered by the agreement;
  3. Deductions from wages for purposes authorised by an employee covered by the agreement;
  4. How the agreement will operate.

Relevant unions are not parties to the agreement as such, but may seek to be covered by it, and certain entitlements arise for them from that coverage.
