The aim of the process, as stated by the legislation, is said to be:

Modern awards:

must be simple to understand and easy to apply, and must reduce the regulatory burden on business; and

  1. together with any legislated employment standards, must provide a fair minimum safety net of enforceable terms and conditions of employment for employees; and
  2. must be economically sustainable, and promote flexible modern work practices and the efficient and productive performance of work; and
  3. must be in a form that is appropriate for a fair and productive workplace relations system that promotes collective enterprise bargaining but does not provide for statutory individual employment agreements; and
  4. must result in a certain, stable and sustainable modern award system for Australia.

The Modern Award Request states that modern awards are not intended to extend award coverage to employees who have been traditionally award-free; to result in high-income employees being covered by awards; to disadvantage employees; to increase costs for employers; or to result in the modification of enterprise awards.

Amongst other things, the AIRC in making modern awards is obliged to have regard for the needs of the low-paid; creation of jobs and promotion of productivity; prevention of discrimination on various grounds; and safety, health and welfare of employees.
