The role of FWA will be to:

  • set and adjust minimum wages;
  • vary Awards;
  • ensure good-faith bargaining;
  • facilitate multi-employer bargaining for the low-paid;
  • deal with industrial action;
  • approve agreements;
  • resolve disputes and unfair dismissals.

Also forming part of the new system will be a related but independent Fair Work Ombudsman, together with a Fair Work Division of both the Federal Court and the Federal Magistrates’ Court. It is intended that the Fair Work Division will be an independent judicial arm of FWA.

Summary

It is fair to say that following the passage of this legislation, Workchoices will be dead. However a principal element of Workchoices that is being maintained under Fair Work Bill is the effective centralisation of the system that saw a significant undermining of state IR systems and a centralisation of IR in Australia within the federal jurisdiction.
